These Terms & Conditions govern access to Hoequipment.shop and purchases from the website. By using the website or submitting an order, the user agrees to these terms, our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, Payment Policy, and Warranty Policy.
1. Eligibility
Customers must be legally capable of entering a binding agreement and must provide accurate information. If a product is intended for a child, an adult must purchase it and is responsible for assembly, installation, supervision, and safe use.
2. Website and Product Information
We make reasonable efforts to keep product descriptions, dimensions, compatibility information, specifications, images, availability, and prices accurate. Screen settings and production changes may cause minor differences in color or appearance. Packaging may change without altering the product materially.
Customers must review product specifications and safety requirements before purchase. Pool sets, vacuums, water slides, pumps, and accessories may have specific requirements relating to surface condition, space, water depth, drainage, electricity, filtration, pressure, age, weight, anchoring, local rules, and adult supervision.
If we identify a material error before dispatch, we may contact the customer for instructions or cancel and refund the affected item. We will not substitute a materially different product without consent.
3. Prices and Availability
Prices are shown in U.S. dollars unless clearly stated otherwise. Product availability and prices may change before an order is submitted. A product placed in a cart is not reserved. Discounts and promotions are subject to the conditions displayed with the offer and cannot be applied after expiration unless we expressly agree.
4. Orders and Acceptance
An order confirmation acknowledges receipt of the customer’s request; it does not necessarily mean the order has been accepted for fulfillment. We may verify payment, inventory, address information, quantity, and fraud indicators before acceptance.
We may decline or cancel an order for legitimate reasons described in our Order Cancellation & Modification Policy. If payment was collected for a canceled item, it will be refunded to the original payment method.
5. Shipping, Risk, and Delivery
Shipping area, costs, processing times, delivery estimates, tracking, address responsibilities, and damaged-package procedures are described in our Shipping & Delivery Policy. Delivery dates are estimates unless we expressly promise a guaranteed service in writing.
Title and risk of loss transfer as provided by applicable law. Nothing in these terms removes our responsibility for a package that is lost or damaged before lawful delivery to the customer.
6. Returns, Refunds, and Cancellations
Return eligibility, the 30-day return window, return shipping responsibility, refund timing, and cancellation procedures are stated in our Return & Refund Policy and Order Cancellation & Modification Policy. These policies form part of these Terms.
7. Safe Product Use
Customers must read and follow all manufacturer instructions, warnings, age and weight limits, electrical requirements, water-depth guidance, installation procedures, maintenance requirements, and local laws.
Pools and water-play products can present drowning, entrapment, diving, slipping, electrical, structural, and other serious hazards. Constant, attentive adult supervision and suitable barriers or safety measures may be required. No product, alarm, cover, fence, vacuum, or accessory replaces adult supervision. Customers should never permit diving unless a product and water depth are specifically designed and approved for it.
Installation, assembly, ground preparation, electrical work, and repairs should be performed by qualified persons where required. Customers must not use a damaged, recalled, improperly assembled, or unsuitable product.
8. Warranty
Commercial warranty coverage is product-specific and is described in our Warranty Policy and any manufacturer documentation. Nothing in these terms limits warranties or consumer rights that cannot be excluded under applicable law.
9. Acceptable Use
Users may not:
- Use the website for unlawful, fraudulent, or abusive activity.
- Attempt to interfere with website security or operation.
- Introduce malicious code, scrape the site in a harmful manner, or access non-public systems without permission.
- Use false identity, billing, delivery, or payment information.
- Infringe intellectual property or privacy rights.
- Reproduce or commercially exploit website content without authorization, except as permitted by law.
We may restrict access or cancel orders associated with prohibited conduct.
10. Intellectual Property
The website’s original text, layout, graphics, logos, and other content are owned by Hoequipment.shop or used with permission and are protected by applicable intellectual property laws. Manufacturer names, product names, and third-party marks belong to their respective owners.
11. Third-Party Services
The website may rely on or link to third-party payment, carrier, manufacturer, analytics, or other services. We are not responsible for a third party’s separate website, content, or independent acts, but this clause does not remove responsibilities we have for orders placed with us.
12. Disclaimer
To the maximum extent permitted by law, the website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free website access. Product warranties are limited to those expressly provided in writing and rights that cannot be excluded by law.
13. Limitation of Liability
To the maximum extent permitted by law, Hoequipment.shop will not be liable for indirect, incidental, special, punitive, or consequential loss arising from website use or a product. Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury caused by negligence where such limitation is prohibited, or any other liability that cannot legally be excluded. Customers remain responsible for safe installation, maintenance, supervision, and use of products in accordance with instructions.
14. Indemnity
To the extent permitted by law, a user agrees to be responsible for losses arising from the user’s unlawful use of the website, violation of these Terms, or infringement of another person’s rights. This provision does not apply to losses caused by Hoequipment.shop or restrict non-waivable consumer rights.
15. Governing Law
These Terms are governed by applicable United States federal law and the laws of the State of Florida, without regard to conflict-of-law principles. Mandatory consumer protections in the customer’s jurisdiction continue to apply where required.
16. Changes
We may update these Terms to reflect changes in our services, operations, or legal obligations. The current version will be posted with a revised “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
17. Severability and Waiver
If any provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision once is not a permanent waiver.
18. Entire Agreement
These Terms and the policies incorporated by reference form the agreement between the customer and Hoequipment.shop regarding website use and purchases, except for any additional written terms expressly agreed by both parties.
